Even though Tracy Morgan has made a career out of making us smile, he’s making sad headlines today.

Morgan’s lawyer tells People that the comedian and 30 Rock star is struggling during his recovery from injuries he sustained in a car crash in June.

He’s really having a tough time,” his New York lawyer, Benedict P. Morelli, said.

The six-car crash left Morgan in a critical condition and ended the life of his longtime friend, James “Jimmy Mack” McNair. Morgan was sent to a long-term rehab facility, then released in July, though he’s still undergoing at-home physical therapy.

Morgan suffered traumatic brain injuries, a broken leg and several fractures to his face. He’s been spotted using a walker, but his lawyer says he still relies on a wheelchair and probably won’t be able to walk normally for several months.

“He’s making incremental progress,” Morelli says. “But they’ll have to wait another month before they assess him cognitively.”

But Morgan has plenty to look forward to as he works to recover. FXX has said The Untitled Tracy Morgan Project, the actor’s upcoming comedy series created by the It’s Always Sunny in Philadelphia team, will be waiting for Morgan when he’s well enough to begin production. The show currently has a 10-episode commitment from the network.

“The only thing we are concerned with is the health and recovery of Tracy Morgan and the victims of this tragic accident,” a June statement from FXX said. “We will support Tracy and his family in every way possible throughout his recovery. At the point when Tracy has recovered and decides that he is ready to go back to work, his show will be waiting for him.”

The series was originally slated to begin production this month and air in January.
