Tracy Morgan was nearly killed when a semitruck hit the limo he was riding in back in June. But the fight is heating up in court, with Walmart — the owner of the semitruck — claiming they weren’t entirely responsible for Morgan’s injuries. But Morgan isn’t happy with the claim and is fighting back.

On Monday, Sept. 29, the retail giant released a statement responding to the lawsuit filed by Morgan and the other plaintiffs, saying that Morgan and the other victims’ injuries “were caused, in whole or in part, by plaintiffs’ failure to properly wear an appropriate available seat belt restraint device.”
The lawsuit explained that the company had to have known that Kevin Roper, the truck driver had been awake for more than 24 hours. And Morgan is incredulous that Walmart would think of blaming the victims in the crash.
“After I heard what Walmart said in court I felt I had to speak out,” Morgan said in a statement to Reuters. “I can’t believe Walmart is blaming me for an accident that they caused. My friends and I were doing nothing wrong.”
The Walmart statement continued by saying that the passengers, “upon information and belief, acted unreasonably and in disregard” of their own safety.

Morgan was severely injured in the crash and suffered a broken leg, nose and ribs. Fellow comedian, James McNair, died in the crash.
Roper has pleaded not guilty to vehicular homicide and assault by auto.
