Joe Jonas‘ divorce from Sophie Turner took an extra contentious turn on Thursday when she filed a lawsuit requesting that she and their two daughters be allowed to move to the U.K. While the courts have historically favored mothers in child custody cases, the Game of Thrones star reportedly has a tough battle ahead of her.

Legal experts are now chiming in on the Hollywood power couple’s court fight and explaining why Jonas might have “the upper hand.” Attorney Neama Rahmani toldUs Weekly, “It really comes down to: What is the home state? And each state is a little bit different, but it’s usually where the children have resided during the six months prior to filing that divorce petition. In this particular case, it seems like the home state is Florida.”

The former duo’s home base had been Miami, and it’s where Jonas filed for divorce. However, the children are now in New York City, and that’s where Turner filed her custody case. On the surface, it may seem like the boy band star has an airtight case, but Rahmani thinks Turner’s legal team may have a trick up its sleeve that could give her “a chance” to win. The 27-year-old actress will not only have to “prove” that the U.K. was a part of their future plans to raise their family, but she will also have to lean into her role as the primary parental caregiver.

“She just needs to prove that it’s in the best interest of the child to move the children out of that home state. That’s just a presumption, but it doesn’t mean that kids have to stay there permanently,” Rahmani shared. If Turner can mount an ironclad case with this angle, then her wishes to return to the U.K. permanently might come true.
