In an industry rife with infidelity, some Hollywood couples have allegedly included cheating clauses in their prenuptial agreements in order to protect them if their spouse is unfaithful. At least that is what has been reported in the media when some of Hollywood’s biggest names tied the knot!
We have to admit, these clauses make sense given how many beloved celebrity couples have fallen apart due to cheating. Infidelity is allegedly what caused Reese Witherspoon and Ryan Phillippe to split in 2007 after started dating his co-star Abbie Cornish. Then there is Jay-Z and Beyoncé who managed to come out the other side of his cheating scandal but not without devastating some fans in the process.
So we don’t blame other celebrity couples tying the knot for wanting to protect themselves from the same fate! Besides, if you’re super rich and you’re already hashing out a prenuptial agreement aimed at protecting assets in case of a divorce, why not just throw in a few extra lines in the to discourage infidelity?
Take Brad Pitt and Angelina Jolie, for example. The couple started their relationship in 2004, while Pitt was still married to Jennifer Aniston, putting their romance at the center of one of the biggest cheating scandals in pop culture history.
So, when they finally tied the knot after 10 years together, it was reported that Jolie was determined to make sure she and the couple’s children were protected if history repeated itself. Those two may not have lasted, cheating clause or not, but some other stars are still going strong despite including their infidelity concerns in their prenups.

Angelina Jolie & Brad Pitt
Angelina Jolie was allegedly concerned that the phrase “you lose them how you get them” would be applicable to her marriage to Brad Pitt.
Jolie and Pitt began their relationship while he was still married to Jennifer Aniston after starring in Mr. & Mrs. Smith in 2005. When they tied the knot nine years later, a clause was allegedly added that would benefit Jolie in case Pitt cheated.
In 2014, Radar Online claimed the clause stipulated that Jolie would get full custody of their six children if Pitt cheated.
As far as we know, cheating had nothing to do with the couple’s 2019 split. Jolie filed for divorce after an alleged incident on their private jet and, in court documents, the Girl, Interrupted actress claimed the Bullet Train star was physically violent to her and at least one of their kids.
Pitt was cleared of any wrongdoing by an FBI investigation however he is reported to be estranged from his kids.
Michael Douglas & Catherine Zeta-Jones
Michael Douglas and Catherine Zeta-Jones have been married since 2000 and are still going strong despite some hardships so we don’t think infidelity is an issue in their marriage.
However, the couple allegedly put some precautions in place in case Douglas strayed from their marriage.
According to the New York Daily News, the couple’s prenup states that Zeta-Jones would get with $2.8 million per year of marriage and an additional $5 million if Douglas cheats.
Jessica Biel & Justin Timberlake
Now that Britney Spears has confirmed rumors that Justin Timberlake cheated on her during their relationship, we may have an explanation for Jessica Biel‘s alleged prenup demand.
When Timberlake and Biel married in 2012, their prenup allegedly included a lifestyle clause that held the Cry Me A River singer accountable if he ever cheated on the 7th Heaven actress.
“Reports of the Timberlake-Biel prenup infidelity clause in 2012 began a trend in so-called ‘lifestyle’ clauses within prenups, postnups and cohabitation agreements,” asset-protection attorney Ann-Margaret Carrozza toldFOX Business in 2019. “These clauses can deal with items of concern such as substance abuse, infidelity, weight gain, spending”
The prenup rumor was resurfaced in 2019 when Timberlake apologized for his “strong lapse in judgment” after photos and videos emerged of him holding hands with his Palmer co-star Alisha Wainwright. Both denied cheating.
Teresa & Joe Giudice
During a 2020 episode of Real Housewives of New Jersey, Teresa Giudice spilled details about her prenup after a heated phone conversation with ex-husband Joe Giudice.
“A week before we were getting married, Joe asked me to sign a prenup and I just felt when you love someone, you don’t do that,” Teresa explained in a confessional, per People.
“I didn’t even read it, I just said, ‘I want you to put one thing in there. If you ever cheat, the prenup is void.’”
The exes were childhood sweathearts before marrying in 1999. They split in 2019 after both serving time in prison for mail, wire and bankruptcy fraud.
Ben Affleck & Jennifer Lopez
Ben Affleck and Jennifer Lopez‘s 2022 nuptials resurfaced some older reports about the alleged prenup they were hashing out before they called off their first engagement in 2004.
As reported by Stylecaster, the couple drafted a prenup that included a clause about cheating.
“The prenuptial agreement is to protect both their assets and says that if they do split they keep their own money, except if Ben cheats,” a source claimed. “Then the prenuptial becomes void. That means that the divorce will be done the normal Californian way—with Jennifer being entitled to up to half of Ben’s earnings.”
20 years ago, the now-married couple postponed their September 2003 wedding days before it was supposed to go ahead and ended their engagement months in January 2004 before reuniting in 2021.
