Katie Holmes is going full-speed ahead with her divorce from Tom Cruise. The latest news? She wants full custody of the couple’s daughter, Suri Cruise. Will she get it?
Katie Holmes might have married Tom Cruise on a “contract” — as was rumored for years — but it turns out she’s the one who wore the real pants in the relationship. The former Dawson’s Creek actress filed for divorce Friday from her husband of almost six years, according to her lawyer.
“This is a personal and private matter for Katie and her family,” attorney Jonathan Wolfe said in a statement. “Katie’s primary concern remains, as it always has been, her daughter’s best interest.”
She’s also seeking “primary residential custody” of the couple’s only daughter, the fabulous Suri Cruise.
Cruise — currently filming a movie in Iceland — also released a statement confirming that Holmes filed for a split. “Kate has filed for divorce and Tom is deeply saddened and is concentrating on his three children. Please allow them their privacy,” his publicist said in a statement.
It only makes sense that Holmes wants full custody of Suri: The pair is always together while Cruise is off gallivanting around the world. Still, we can’t help but feel a smidge sorry for the Rock of Ages actor, especially since he just gushed about her in Playboy.
“She is an extraordinary person, and if you spent five minutes with her, you’d see it. Everything she does, she does with this beautiful creativity,” he said in the June issue interview.

Plus, she’s about to get a big piece of Cruise’s fortune, thanks to their prenuptial agreement. In the agreement, Holmes is entitled to $3 million for each year they’re married — so she’ll get about $15 million if that’s true. In any case, the power in their relationship has shifted and Holmes is in a much better position than she was in 2006.

“If she walks now, Tom will fight her for custody of [daughter Suri], and Katie can’t outlast him in court,” an insider told Life & Style magazine in 2006, adding that Holmes’ parents didn’t want her to marry Cruise but she really couldn’t avoid it to keep her daughter. “She knows she needs to marry him to get the money to fight him for custody, if it comes to that.”
As for Suri? We’re sure she’s currently playing dress-up in her huge treehouse and isn’t aware of what’s going on. However, she did release a “statement” — or her comedian alter-ego did on the Tumblr blog Suri’s Burn Book.
“Please respect my privacy during this difficult time. (Just mine though — everyone else is fair game,) Suri “wrote” on Friday.
“I will be vacationing in the Cayman Islands for the Independence Day holiday with my financier, and going over my plans to seek sole custody of myself. I appreciate the concern and the warm wishes.”
Somehow we don’t think this is too far off from reality.
